Judicial Watch Issues Statement on Appeals Court Decision Blocking Hillary Clinton Testimony

 

Today I made the following statement about the decision by the U.S. Court of Appeals for the District of Columbia Circuit regarding the request of former Secretary of State Hillary Clinton’s and her former Chief of Staff, Chery Mills to avoid testifying under oath about Clinton’s emails. The court granted Clinton’s request to avoid testimony but denied Mills’.

Today’s extraordinary Appeals Court decision protecting Hillary Clinton from having to obey a court order requiring her to testify about her emails is contrary to longstanding precedent and undermines the Freedom of Information Act (FOIA). The opinion’s deviation from a long line of earlier mandamus cases creates the appearance of favoritism towards Clinton and undermines the public’s confidence in the fair administration of justice. One need only contrast the DC Circuit’s agony over granting General Flynn mandamus relief with the unprecedented mandamus relief so easily given to Clinton.

 

As Secretary of State, Hillary Clinton hid her government emails, then stole them when she left office. Her lawyers unilaterally determined what would be returned later. The State Department knew this occurred but tried to game a federal trial court into shutting down Judicial Watch’s FOIA lawsuit before Clinton’s scheme became public. In response, the trial court rightly ordered Clinton to testify about the reasons for her actions and their impact on the public’s right to know. That this was too much for the DC Circuit is a miscarriage of justice.

 

In addition to today’s political decision, the Justice and State Departments’ continuing efforts to avoid getting to the bottom of Clinton’s email misconduct are a scandal. President Trump should hold Secretary Pompeo and Attorney General Barr accountable for their failures of leadership.

What is known, based on press leaks and a letter Senate Judiciary Committee Chairman Chuck Grassley sent Lynch, is that in March 2016, the FBI received a batch of hacked documents from U.S. intelligence agencies that had access to stolen emails stored on Russian networks. One of the intercepted documents revealed an alleged email from then-DNC Chairwoman Wasserman Schultz to an operative working for billionaire Democratic fundraiser George Soros. It claimed Lynch had assured the Clinton campaign that investigators and prosecutors would go easy on the presumptive Democratic presidential nominee regarding her use of a private email server while serving as secretary of state. Lynch allegedly made the promise directly to Clinton political director Amanda Renteria.

Clinton mentioned fascist dictators Adolf Hitler and Benito Mussolini and, although she never explicitly used Trump’s name, she referenced him quite frequently during her speech and repeated a few accusations against him, including Russian interference in the 2016 presidential election and obstruction of justice.

"I think with the rapidity with which information can be conveyed today because of the internet, it is an even more dangerous set of circumstances..." Clinton said, seemingly comparing Trump's America to Hitler's Germany and Mussolini's Italy.

Despite Comey Assurances, Vast Bulk of Weiner Laptop Emails Were Never Examined

Here's the bottom line: Comey lied as part of the Hillary cover-up.

When then-FBI Director James Comey announced he was closing the Hillary Clinton email investigation for a second time just days before the 2016 election, he certified to Congress that his agency had “reviewed all of the communications” discovered on a personal laptop used by Clinton’s closest aide, Huma Abedin, and her husband, Anthony Weiner.

At the time, many wondered how investigators managed over the course of one week to read the “hundreds of thousands” of emails residing on the machine, which had been a focus of a sex-crimes investigation of Weiner, a former Congressman.

Comey later told Congress that “thanks to the wizardry of our technology,” the FBI was able to eliminate the vast majority of messages as “duplicates” of emails they’d previously seen. Tireless agents, he claimed, then worked “night after night after night” to scrutinize the remaining material.

But virtually none of his account was true, a growing body of evidence reveals.

In fact, a technical glitch prevented FBI technicians from accurately comparing the new emails with the old emails. Only 3,077 of the 694,000 emails were directly reviewed for classified or incriminating information. Three FBI officials completed that work in a single 12-hour spurt the day before Comey again cleared Clinton of criminal charges.

It gets worse:

Although the FBI's New York office first pointed headquarters to the large new volume of evidence on Sept. 28, 2016, supervising agent Peter Strzok, who was fired on Aug. 10 for sending anti-Trump texts and other misconduct, did not try to obtain a warrant to search the huge cache of emails until Oct. 30, 2016. Violating department policy, he edited the warrant affidavit on his home email account, bypassing the FBI system for recording such government business. He also began drafting a second exoneration statement before conducting the search.

The search warrant was so limited in scope that it excluded more than half the emails New York agents considered relevant to the case. The cache of Clinton-Abedin communications dated back to 2007. But the warrant to search the laptop excluded any messages exchanged before or after Clinton's 2009-2013 tenure as secretary of state, key early periods when Clinton initially set up her unauthorized private server and later periods when she deleted thousands of emails sought by investigators.

Far from investigating and clearing Abedin and Weiner, the FBI did not interview them, according to other FBI sources who say Comey closed the case prematurely. The machine was not authorized for classified material, and Weiner did not have classified security clearance to receive such information, which he did on at least two occasions through his Yahoo! email account – which he also used to email snapshots of his penis.

So the leadership of the FBI covered up for Hillary and lied to Congress and the public.  Despite their best efforts, Trump won.  So they went to plan "B"  - impeachment.

Now here's an intersting view.  He could be right.

Rod Rosenstein, Robert Mueller, and the rest of their merry band of brothers know one thing all too clearly. They are not there to prosecute Trump; that is only a tactic to achieve the real goal. This entire drama has been played out, not to indict Trump, but to prevent the country from understanding how truly depraved, traitorous, and duplicitous the regime of Barack Hussein Obama really was. They cannot stop this investigation because if they do, Hillary, Obama, Kerry, Jarrett, all of them, go directly to jail without passing go.

Mueller is not a special prosecutor, he is a goalie, meant only to protect the truth from coming out.

In Russia, when Boris Yeltsin’s health was failing and it was obvious it was time for a new leader, good old Boris chose Vladimir Putin. Why? Because he was assured Putin would not prosecute his family for the billions and billions they had stolen by raping the country they were supposed to lead.

When Hillary lost the election, the Left in America was shocked. Hillary was supposed to play Putin’s role, to prevent anyone from finding out how deep the Hussein rabbit hole of treason really went. This is why Hillary famously apologized to Barack when she lost. “I’m sorry, Barack,” she said.

When it was obvious Trump was going to win, they had to come up with another plan. I have to admit, the plan was created with evil genius. They decided to try and bring down Trump with an orchestrated campaign to find, or create, some type of Russia collusion, to stop his agenda, delegitimize his presidency, and buy time to install another goalie in The White House.

Barack and his merry band of traitors weakened America on purpose. They moved hundreds of billions of dollars to their fat cat bosses in the union sector, they almost destroyed our military, they betrayed us to our enemies, they betrayed our allies, the divided us by race. In short, they did their best to destroy this great country, and get rich at the same time. As his preacher famously said, “God Damn America!” (And those white people too).

No, Mueller can’t stop. If he does, the entire house of cards comes crashing down. The Left will be finished in America for a generation. Barack, Valerie, Hillary and the rest of them go to the big house. Then we find out the real extent of their crimes against the people.

As promised, at the start of his sermon, the Cardinal pointed out that Ms. Pelosi was present.

The Cardinal went on to explain to the congregation, "While Ms. Pelosi's presence is probably an honor to some, the woman is not numbered among my personal favorite personages. Some of her most egregious views are contrary to tenets of the Church, and she tends to flip-flop on many other issues. Nancy Pelosi is a petty, self-absorbed hypocrite, a thumb sucker, and a nit-wit. Nancy Pelosi is also a serial liar, a cheat, and a thief. I must say, Nancy Pelosi is the worst example of a Catholic I have ever personally witnessed. She married for money and is using her wealth to lie to the American people. She also has a reputation for shirking her Representative obligations both in Washington and in California . The woman is simply not to be trusted."

Former secretary of state Clinton is a free woman largely thanks to the tender loving care that the FBI provided her and her conspirators during its probe of her illegal, unsecure email server and related abuse of government secrets. GOP lawmakers concluded this after grilling FBI deputy director Andrew McCabe on December 21, behind closed doors, according to John Solomon’s molar-grinding expose in Tuesday’s The Hill.

“For the first time, investigators say they have secured written evidence that the FBI believed there was evidence that some laws were broken,” Solomon reported. This proof includes what Solomon calls revelations of “irregularities and contradictions” in the FBI’s inquiry.
